How a Rent-a-Room Licence Agreement works

Guidance for homeowners renting a room, supported by SigSwift

BUILT TO HELP PROTECT BOTH PARTIES FROM WHAT CAN GO WRONG

Ensure you put protections in place for what can go wrong

The agreement goes beyond names, dates and payment amounts. It records practical rights, responsibilities and remedies for both the homeowner and the person renting the room.

Payments, bills and late payment Record the licence fee, payment schedule, included household expenses, deposit and the steps that apply if an amount remains unpaid.
Your protection as the licensor

Provides a written payment obligation, a process for overdue sums and termination rights for sufficiently serious or repeated non-payment.

Deposit handling and return Record the deposit, the permitted reasons for deductions, the evidence required and when the balance must be returned.
Your protection as the licensor

Allows actual and reasonable losses for damage, missing items, cleaning, keys, unpaid sums or failure to give agreed notice to be deducted where applicable.

Privacy, bedroom access and security Explain when the homeowner may enter the bedroom, the notice expected where practicable, and the licensee’s responsibilities for keys and household security.
Your protection as the licensor

Retains overall control of the owner-occupied home and records obligations concerning locks, keys, guests and security.

Repairs, safety and essential facilities Set out responsibilities for the condition of the room, shared areas, heating, hot water, appliances, fire safety and urgent defects.
Your protection as the licensor

Makes clear that the homeowner is not responsible for damage or conditions caused by the licensee and allows reasonable time to remedy non-urgent issues.

House rules and shared spaces Record the agreed position on guests, overnight stays, smoking, pets, working from home, cleaning, quiet hours, permitted common areas and shared facilities.
Your protection as the licensor

Makes the standards expected within the homeowner’s own home clear before occupation begins.

Notice, termination and serious breaches Record the ordinary notice required from each party, how notice may be delivered, what must be remedied first and when immediate termination may be appropriate.
Your protection as the licensor

Provides routes to end the arrangement for serious non-payment, violence, threats, harassment, anti-social behaviour, illegal conduct or serious property damage.

Moving out and belongings left behind Explain when occupation ends, when keys must be returned, how overholding is treated and the process for belongings remaining at the property.
Your protection as the licensor

Records the obligation to vacate, return access devices and pay for unauthorised overholding or direct losses where applicable.

Both parties can review these terms before moving in, propose changes where appropriate and decide whether the arrangement is right for them.

The clauses included in a completed agreement depend on the answers provided and the circumstances selected. The agreement cannot remove mandatory rights or obligations that apply by law.

The wrong expectations can make your own home uncomfortable.

When someone rents a room in your home, you may share a kitchen, bathroom, living areas and everyday routines. A short advert or informal conversation rarely covers everything that matters. A written draft brings those expectations into the open before someone moves in.

Without clear written expectations

  • Applicants may assume different rules about guests, overnight stays, quiet hours or pets
  • Payment dates, included bills and permitted deposit deductions may be disputed
  • Privacy, bedroom access, repairs and responsibility for damage may be unclear
  • Neither party may know what notice to give or what happens after a serious breach
  • Incompatibilities may emerge only after someone has moved in

With a draft shared in advance

  • Applicants can review the actual house rules and permitted facilities before responding
  • Payment, bills, deposits and deductions are recorded in advance
  • Privacy, access, safety and repair responsibilities are addressed for both parties
  • Notice, termination and serious-breach procedures are set out in writing
  • Both parties sign the same final document and keep an evidence-backed record

Is this the right agreement for you?

Suitable for

A homeowner offering a room in the home they also occupy.

A homeowner who wants prospective licensees to understand the proposed terms before moving in.

A homeowner who wants to record payments, shared spaces, household expectations and notice arrangements.

Both parties completing their agreement and signatures online.

Things to check first

Whether an arrangement is a licence or a tenancy depends on the real circumstances, not the title of the document.

A person renting a room in an owner-occupied home may not have the same protections as a tenant in a conventional tenancy. Clear written terms are therefore particularly important for both parties.

If the owner will not live in the home, or the legal position is unclear, seek individual legal advice.

A LITTLE MORE CLARITY

Frequently asked questions

Plain-English answers about drafting, sharing and signing your Rent-a-Room Licence Agreement.

Can I include the draft agreement in my room advertisement?

Yes. A draft can show interested applicants the proposed payments, household rules, shared spaces, responsibilities and notice arrangements before they apply or commit. This may discourage unsuitable applicants and help attract people who value clear, fair expectations. You can create a sharable draft agreement for free. You only pay when both parties are ready to sign.

Why should I share the agreement before choosing someone?

Sharing it early gives both parties an opportunity to identify different expectations before someone moves in. It can make conversations about visitors, bills, noise, shared spaces and notice easier and more objective.

Does the agreement protect both parties?

Yes, it can include practical contractual protections for both parties. For example, it can record h ow the deposit is handled, when the homeowner may enter the bedroom, responsibilities for repairs and essential facilities, the house rules, the notice each party must give, and rights to end the arrangement after serious breaches. It also gives both parties the same written reference. It cannot guarantee compatibility, prevent every dispute or remove rights and obligations that apply by law.

What protections can the agreement give the homeowner?

Depending on the options selected, it can record payment and deposit obligations, rules for guests and shared spaces, security and key responsibilities, standards of conduct, responsibility for damage, notice requirements, overholding terms and termination rights following serious or repeated breaches.

What protections can it give the person renting the room?

Depending on the options selected, it can record the facilities and shared areas they may use, reasonable privacy in the bedroom, how and when the homeowner may enter, responsibilities for repairs and safety, deposit-return rules, notice requirements, and termination rights where serious or persistent problems affect safety, health, access, privacy or essential facilities.

Do I need a printer?

No. You can create and review the agreement online. When the final terms are ready, both parties can sign electronically using a phone, tablet or computer and download the completed agreement.

Are electronic signatures recognised in Ireland?

Yes. In Ireland, sections 13 and 19 of the Electronic Commerce Act 2000 recognise the use of electronic signatures and electronic contracts, subject to the applicable conditions, including consent. At EU level, Article 25(1) of Regulation (EU) No 910/2014 (the eIDAS Regulation), as amended, provides that an electronic signature cannot be denied legal effect or admissibility as evidence solely because it is electronic or is not a qualified electronic signature. SigSwift records each party’s consent to use electronic records and signatures and their active signing event. The usual requirements for forming an agreement still apply, and some specialised documents may require additional formalities.

What is the difference between a licence and a tenancy?

The distinction depends on the actual circumstances, including how the home is occupied. Calling a document a licence does not decide its legal status. Seek individual legal advice if you are unsure.

Can I include house rules?

Yes. You can record practical expectations about shared areas, visitors, overnight guests, smoking, noise, pets and other matters that prospective licensees should understand before deciding whether the arrangement suits them.

What happens when someone wants to leave?

The agreement records the notice arrangements you choose. Those terms should suit the real circumstances and cannot remove rights or obligations that apply by law.

Can I review the agreement before payment?

Yes. You can review the customised draft before payment and before inviting anyone to sign.
