Renting a room in someone’s home?

Don’t rely on verbal promises.

People renting a room in an owner-occupied home may not have the statutory protections that apply to a conventional tenancy. Create a draft agreement that records your payment, deposit, privacy, access, facilities, house rules, notice and rights if serious problems arise. Share it with the homeowner before you decide to move in.

  • See your proposed protections before paying a deposit
  • Clarify privacy, access, facilities and house rules
  • Agree what happens if either party wants to end the arrangement
  • Finalise and sign online—no printer needed

Create, review and share your draft before payment

Review these terms before paying a deposit or moving in. Identify an unsuitable arrangement before committing.

The agreement cannot remove mandatory rights or determine by its title alone whether the arrangement is legally a licence or tenancy.

Informal promises are not the same as agreed written terms.

A person renting a room in an owner-occupied home may not have the statutory protections that apply to a conventional tenancy. Clarify the arrangement and record it before committing.

Without a written agreement

  • Verbal promises may be difficult to establish later
  • Bedroom access may be unclear
  • Deposit deductions may not be recorded
  • Included bills and facilities may be disputed
  • House rules and notice expectations may change
  • There may be no agreed process when serious problems arise

With a SigSwift agreement

  • Payment, bills and deposit arrangements are recorded
  • Privacy and bedroom-access terms are addressed
  • Included facilities and shared areas are identified
  • Repair and safety responsibilities are set out
  • Notice and serious-breach procedures are agreed
  • Both parties retain the same signed record

Is this the right agreement for you?

Suitable for

Things to check first

Whether an arrangement is a licence or a tenancy depends on the real circumstances, not the document title.

A person renting a room in an owner-occupied home may not have the statutory protections that apply to a conventional tenancy. A written agreement can create important contractual protections but cannot create statutory tenancy rights that do not otherwise apply.

If the owner will not live in the home, you will have exclusive possession, or the legal position is unclear, seek individual legal advice.

A LITTLE MORE CLARITY

Frequently asked questions

Plain-English answers about creating, sharing and signing an agreement as a prospective licensee.

Can I create the agreement if I am the person renting the room?

Yes. Either party can create the draft. You can set out the terms you want clarified and share it with the homeowner. Both parties can discuss changes before proceeding.

Why is a written agreement particularly important for a licensee?

A person renting a room in an owner-occupied home may not have the statutory protections that apply to a conventional tenancy. A written agreement can create important contractual protections and records what both parties agreed.

What protections can the agreement give me?

Depending on the options selected, it can record included bills and facilities, deposit-return rules, reasonable bedroom privacy, homeowner access, repair and safety responsibilities, notice requirements, and rights where serious problems arise.

Does the agreement give me the same rights as a tenant?

No. It cannot create statutory tenancy rights that do not otherwise apply. Whether an arrangement is a licence or tenancy depends on the real circumstances, not the document title. It can still create important contractual rights and obligations.

Can I share the draft before paying?

Yes. You can create, review and share the draft before payment. Payment is required only when the final draft is ready to be put in place and sent for signing.

How much does the completed agreement cost?

Once both parties are satisfied with the final draft, the total cost is €25 including VAT. This includes creating the final agreement and inviting both parties to sign online.

Do I need a printer?

No. Both parties can review and sign online using a phone, tablet or computer and download the completed document.

Are electronic signatures recognised in Ireland?

Yes. In Ireland, sections 13 and 19 of the Electronic Commerce Act 2000 recognise the use of electronic signatures and electronic contracts, subject to the applicable conditions, including consent. At EU level, Article 25(1) of Regulation (EU) No 910/2014 (the eIDAS Regulation), as amended, provides that an electronic signature cannot be denied legal effect or admissibility as evidence solely because it is electronic or is not a qualified electronic signature. SigSwift records each party’s consent to use electronic records and signatures and their active signing event. The usual requirements for forming an agreement still apply, and some specialised documents may require additional formalities.

What should I clarify before moving in?

Check the fee, included bills, deposit, permitted areas and facilities, privacy and access, guests, pets, working from home, cleaning, quiet hours, repairs, safety and notice.

What if the homeowner will not live in the property?

The arrangement may not be a room licence of this kind. Its legal status depends on the actual circumstances. Seek individual legal advice if the owner will not live there or the position is unclear.

Need advice about your particular circumstances? Consider getting independent legal advice before proceeding.
