A friendly arrangement still needs proper employment terms.

Reduce the risk of blurred working hours, expanding duties and disputes inside your home. Agree what childcare is included, when the au pair is working or off duty, how pay and leave operate, and the safeguarding, privacy and fair procedures both sides can rely on. Attract better applicants by being transparent.

A LITTLE MORE CLARITY

Frequently asked questions

Plain-English au pair employment answers.

Is an au pair an employee?

In Ireland, the label au pair does not remove employment rights where the real arrangement is employment.

Can either party create the draft?

Yes. The employer or prospective au pair can create and share it.

Does accommodation replace wages?

No. Any permitted board or lodging treatment must comply with applicable minimum-wage rules.

Can cameras be used in the home?

Only on a lawful, necessary, proportionate and transparent basis; private areas must not be monitored.

Do we need a printer?

No. Both parties can sign online.

Are electronic signatures recognised in Ireland?

Yes. In Ireland, sections 13 and 19 of the Electronic Commerce Act 2000 recognise the use of electronic signatures and electronic contracts, subject to the applicable conditions, including consent. At EU level, Article 25(1) of Regulation (EU) No 910/2014 (the eIDAS Regulation), as amended, provides that an electronic signature cannot be denied legal effect or admissibility as evidence solely because it is electronic or is not a qualified electronic signature. SigSwift records each party’s consent to use electronic records and signatures and their active signing event. The usual requirements for forming an agreement still apply, and some specialised documents may require additional formalities.

Seek employment or safeguarding advice where the arrangement is unusual or responsibilities are unclear.
